While the court indicated that on a case-by-case basis there could exist journalistic privilege to shield secret sources, it rejected a bid by the National Post to create a blanket protection for journalists.
The ruling effectively upholds a lower court ruling --- in this instance, a source seeking protection from police investigation in a forgery case. It doesn't alter practice, but it could have created a new right if the case had swung the other way.
The court did say that several factors could influence privilege: the public interest role of the case, the value of evidence and the seriousness of the crime involved.
